Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Crew: Bike Clubs & Rides mobile application (the "App") operated by MoStudios LLC ("MoStudios," "we," "us," or "our").

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.

1. Accounts

1.1 Account Creation

To use the App, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

1.2 Account Accuracy

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

1.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including if we reasonably believe you have violated these Terms.

2. Use of the App

2.1 Permitted Use

The App is designed for motorcycle and bike clubs to organize group rides, manage membership, share announcements, and coordinate activities. You agree to use the App only for its intended purposes.

2.2 Prohibited Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Post content that is defamatory, obscene, threatening, harassing, or otherwise objectionable
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the App or servers or networks connected to the App
  • Attempt to gain unauthorized access to any portion of the App or any other systems or networks
  • Use the App to collect or harvest any personally identifiable information
  • Use any automated means to access the App or collect data from it
  • Circumvent, disable, or otherwise interfere with security-related features of the App

3. Crews and Membership

3.1 Crew Creation

Users may create private groups called "crews." The user who creates a crew becomes its Admin and is responsible for managing the crew, its members, and its content.

3.2 Crew Roles

Crews have a role-based system consisting of Admins, Officers, and Members. Admins have full control over crew settings, membership, and content. Officers have elevated permissions as granted by Admins. Members can participate in rides and view crew content.

3.3 Crew Moderation

Crew Admins are solely responsible for moderating content and members within their crew. MoStudios does not actively monitor user-generated content and is not responsible for content posted by users.

4. User Content

4.1 Ownership

You retain ownership of any content you submit, post, or display on or through the App ("User Content"). By posting User Content, you grant MoStudios a non-exclusive, royalty-free, worldwide license to use, store, display, and distribute such content solely for the purpose of operating and providing the App.

4.2 Content Responsibility

You are solely responsible for all User Content you create, upload, or share. You represent and warrant that you have all rights necessary to grant the license above and that your User Content does not infringe any third-party rights.

4.3 Content Removal

We reserve the right, but are not obligated, to remove any User Content that violates these Terms or that we find objectionable for any reason, without prior notice.

4.4 Content After Account Deletion

If you delete your account, content you created may remain visible to other crew members but will be attributed to "Former Member."

5. Subscriptions and Payments

5.1 Subscription Requirements

Certain features of the App, including the ability to post rides, announcements, and manage crew members, require an active subscription. Subscriptions are available on a monthly or yearly basis.

5.2 Billing

Subscriptions are billed through Apple App Store (iOS) or Google Play Store (Android). All billing, payment processing, and subscription management are handled by the respective app store. You agree to the app store's terms of service and payment policies.

5.3 Subscription Lapse

If your subscription lapses, you will lose access to posting features. Your crew and member data will remain accessible, but you will not be able to create new rides or announcements until you renew your subscription.

5.4 Refunds

Refund requests must be directed to Apple or Google, as applicable, in accordance with their refund policies. MoStudios does not process refunds directly.

6. Location Services

The App uses your device's location to enable check-in functionality at ride locations. Location access is only used while the App is in the foreground. By using the check-in feature, you consent to the App accessing your location. You may disable location access at any time through your device settings.

7. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of MoStudios LLC. The App is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without the prior written consent of MoStudios LLC.

8. Third-Party Services

The App may contain links to third-party services, including mapping applications (Apple Maps, Google Maps, Waze) for navigation. We are not responsible for the content, privacy policies, or practices of any third-party services. You access third-party services at your own risk.

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MOSTUDIOS DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

MOSTUDIOS MAKES NO WARRANTY REGARDING THE SAFETY OF ANY GROUP RIDES ORGANIZED THROUGH THE APP. YOU PARTICIPATE IN RIDES AT YOUR OWN RISK AND ARE SOLELY RESPONSIBLE FOR YOUR SAFETY AND COMPLIANCE WITH ALL APPLICABLE TRAFFIC LAWS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOSTUDIOS LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the App
  • Any conduct or content of any third party on the App
  • Any content obtained from the App
  • Unauthorized access, use, or alteration of your transmissions or content
  • Any injuries, accidents, or damages arising from participation in group rides

11. Indemnification

You agree to defend, indemnify, and hold harmless MoStudios LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in the United States.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised Terms.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
